Regulations

1. Introduction

These Terms and Conditions set forth the rules for using the online store available at https://roadeu.com/ and constitute an integral part of the sales agreement between the customer and Road Dudkiewicz Sp. J., with its registered office in Dzierżoniów, registered under Tax Identification Number (NIP): 8822125884.

Definitions For the purposes of these rules, the following terms shall have the following meanings:

Customer – a natural or legal person who orders products through the Store;

Product —a movable item being sold for the purposes of the Store;

Store – an online service available at https://roadeu.com/sklep, enabling the conclusion of distance sales contracts between Customers and the Company;

Sales Agreement —an agreement entered into between the Customer and the Company regarding the sale of a Product;

2. Terms of Use for the Store

1. The customer has the right to make purchases in the Store, subject to current prices and product availability;
2. The customer is required to provide accurate information, in particular their first name, last name, email address, and shipping address;
3. The customer has the right to cancel the Sales Agreement within 14 days without giving a reason, in accordance with the Consumer Rights Act;
4. The customer may use the contract withdrawal form, which is attached as Appendix 1 to these Terms and Conditions;
5. Complaints regarding Products may be filed in accordance with the provisions of the Consumer Rights Act.

3. Shipping and Delivery

The Company agrees to deliver the Product to the address specified by the Customer within the timeframe indicated on the Store’s website;

• The Customer is responsible for shipping costs, in accordance with the current rates listed on the Store’s website;
• The company undertakes to secure the Product in a manner that ensures its safe transport;
• If damage to the Product is discovered during delivery, the Customer has the right to refuse to accept it and file a complaint.

4. Payments

1. The customer may pay for the Product using the payment methods available on the Store’s website, including bank transfer and online payment;
2. If payment is made by bank transfer, the Customer is required to make the payment by the date specified on the invoice;
3. If payment cannot be processed, the Company reserves the right to cancel the order and, consequently, to issue a refund for the order.

5. Protection of Personal Data

1. The Customer consents to the processing of their personal data by the Company for the purpose of fulfilling the Sales Agreement and shipping the Product;
2. The Company undertakes to protect the Customer’s personal data and to comply with all applicable laws regarding the protection of personal data, in particular the Personal Data Protection Act;
3. The customer has the right to view, edit, and delete their personal data.

6. Final Provisions

1. The Terms and Conditions are available on the Store’s website and are binding on the Customer;
2. Any changes to the Terms and Conditions take effect upon their publication on the Store’s website;
3. In matters not covered by these Terms and Conditions, the provisions of the Civil Code and the Consumer Rights Act shall apply;
4. If any provision of these Terms and Conditions is inconsistent with applicable law, such provision shall be deemed invalid and replaced with a provision that most closely reflects its intent and is consistent with the law. All other provisions of these Terms and Conditions shall remain in full force and effect;
5. Any disputes arising from the performance of the Sales Agreement between the Company and the Customer shall be settled by the competent common courts in Poland with jurisdiction over the Company’s registered office.

7. Complaints and Returns

1. The customer has the right to file a complaint regarding the Product within 14 days of receiving the Product;
2. Complaints must be submitted in writing to the Company’s address or via email to: kontakt@roadeu.com/sklep/roadeu.com/sklep;
3. If a complaint is deemed valid, the Company agrees to immediately remedy the defect or replace the Product with a new one;
4. The customer has the right to cancel the Sales Agreement without giving a reason within 14 days of receiving the Product, in accordance with the Consumer Rights Act.

8. Card Payments and Refunds

2. The provider of online payment services for card payments is Autopay S.A.

3. Available card payment methods: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro.
4. For orders paid by credit card, the order processing time is calculated from the moment the payment is successfully authorized.
5. If a refund is required for a transaction made with a payment card, the refund will be issued to the bank account associated with the Ordering Party’s payment card.
6. The seller shall refund the payment using the same payment method the consumer used, unless the consumer has expressly agreed to a different method of refund that does not entail any costs for the consumer.

These Terms and Conditions are an integral part of the Sales Agreement entered into between the Company and the Customer. The Customer’s acceptance of these Terms and Conditions is a condition for the conclusion of the Sales Agreement.
